Joint custody - its assumptions, strengths and potential weaknesses in the light of psychology

This bachelor thesis deals with joint custody in relation to its assumptions, strengths and potential weaknesses in the light of psychology. The theoretical part provides insight into the context of the form of contemporary family, with the issue of divorce and its impact on all involved individuals and with different forms of parenting. The legislative grounding of post divorce child care and its possible forms in the Czech legal order is also covered. The psychological assumptions of joint custody of both the parents and the child are emphasized to a great extent. On the basis of these findings are drawn possible strengths and weaknesses of joint custody. Last but not least are presented different approaches to joint custody among a few selected countries. The final part of this thesis is designed as qualitative research project focusing on the evaluation of joint custody from the perspective of individuals who have personal experience with this post-divorce arrangement. Parents´ divorce in young adult's eyes

The main aim of this bachelor thesis is to introduce the phenomena of the parents´ divorce in young adult´s eyes. The paper is divided into two sections, theoretical and empirical part. The theoretical part defines the basic concepts such as family, parents´ divorce, post-divorce arrangement and characteristics of young adults. This theoretical part shows the dynamics of divorce with its phenomena and then describes young adulthood with its typical signs. In the empirical section is described and analyzed reflection on parents´ divorce by young adult respondents. They provided their experiences with parents´ divorce, its dynamics, view of it and perceived consequenses to their current life. Data were collected through in-depth semi-structured interviews which have been analysed by using an open coding. The questioned group consists of six young adult respondents who had experience with parents´ divorce and were able to discuss it based on their memories and personal experience. The results were described as individual case reports telling the story of parents´ divorce. The stories were presented in categories and subcategories revealing main topics from interviews. From the collected data is possible to conclude that young adults frequently perceived the changes which parents´ divorce brings into their family life. Respondents consider parents´ divorce as psychologically demanding situation for a child who is suddenly in a new and fundamentally changing family background. The respondents also recognice a divorce as an experience they would want to avoid in their personal relationships.
Psychological Context of Shared Custody

5 Abstract This bachelor thesis concerns the issue of shared custody as a form of post-divorce arrangement. The overview part comprises a short introduction to issues related to family transformations, divorce rate in the Czech Republic, legal definitions of marriage and divorce, and conditions of both it's formation and dissolution. A separate chapter also regards the consequences of absence of one of the parents during child-rearing. The thesis further encompasses an overview of various types of post-divorce arrangements, their incorporation in Czech legal system and the terminology used in English-written research articles. The very substance of the overview part of this thesis is the shared custody itself as a form of post-divorce arrangement and factors affecting it. In relation to shared custody I mention both it's advantages and disadvantages for everyone involved, shared custody from the children's point of view, characteristics of families going through with shared custody and experiences with it from abroad. Finally, the thesis outlines a draft of a qualitative research project, which aims to examine factors affecting the process of shared custody in Czech families based on interviews with their family members, where shared custody, at least for a limited time, took place.
